1. Information about the Website
The use of the website bloomingcreativestudio.pt, as well as the associated services, implies the acceptance by the client/user of these terms and conditions of use in accordance with Decree-Law 24/2014, of February 14, Amendments to Decree-Law 109-G/2021, of December 10 (from 05/28), as well as knowledge of the privacy policy.
By making a purchase, you agree that you have read and accepted these Terms and agree to be legally bound by them.
Blooming Creative Studio is a brand managed by Inês Diogo Varela, NIF 256588830, headquartered in Vivenda S. José, Cruz dos Madeiros, Monchique, contactable via email info@bloomingcreativestudio.pt .
2. Services and products
Blooming Creative Studio provides custom and pre-designed graphic design, production and printing services, and sales of digital products.
3. Prices
For prices on our collectibles and templates, please visit our online store. In relation to other products, as these are personalized products in which prices vary according to the piece, materials, specificity, finishes and quantities, prices are subject to prior budget.
The quotes sent are valid for 30 days after the date of sending. All options described in the quote may be subject to changes agreed between you and Blooming Creative Studio. When awarding the quote, the client acknowledges and agrees to all the conditions set out therein.
The prices shown on the website and online store bloomingcreativestudio.pt include VAT at the legal rate in force. All prices include taxes and mandatory fees in force.
Payment term
In the case of the sale of digital products, payment is made at the time of purchase.
In the case of the sale of personalized products or those that require production, a copy of the quote must be dated and signed by the client to indicate acceptance of the proposal and must be returned to Blooming Creative Studio. Alternatively, the customer may send an email accepting the quote and terms and conditions. No work will commence until acceptance of the quote and terms and conditions is received by Blooming Creative Studio.
Charges for any additional services beyond the estimated project will be re-quoted and payment must be made to commence the project.
Payment for semi-custom and custom projects (excluding those sold directly through the website, in which 100% is paid before work begins) is divided into two parts: 60% at the time of award and 40% after approval of the final model and before printing of the final product begins.
At the time of acceptance of the budget (award), an invoice will be issued for 60% of the amount agreed in the budget. Payment must be made and proof sent to info@bloomingcreativestudio.pt stating the name of the client provided in the quote.
Amounts are non-refundable if work has already started.
For projects outside the original budget, 100% payment (non-refundable) may be requested at the time of award.
Failure to pay the agreed amounts within 30 days after sending the invoice requires cancellation of the contract, therefore the work will be incomplete or will not even be started.
Shipping costs
Delivery costs are borne by the customer. Their value will be made known at the time of the quote.
4. Payment and delivery or execution methods
Payments can be made through the Etsy store, the official Blooming Creative Studio online store, bank transfer or MBWay, if available. Through the official website we also offer Paypal and credit card.
Execution deadlines
Once the quote has been sent by email and confirmation of the 60% down payment has been received:
For pre-designed models:
- Within 5 to 7 business days* the digital proposal of the piece will be sent by email. This part can change if needed.
- With final approval of the digital proposal, a physical model will be produced and sent to the client's address.
- After approval of the physical model, payment of the remaining amount will be made and final production will begin upon confirmation of payment.
- The average estimated final delivery time is 2 to 3 weeks, after payment confirmation*.
* Estimated date. The client will always be informed about deadlines throughout the development of the project.
If a material is chosen that is unavailable, the customer will be notified and if they do not wish to exchange the material for a similar one, they will be reimbursed the value of that material within 30 days.
Delivery
In the case of digital products, an email will be sent with a link to access the file via the Templett platform.
For physical products, delivery can be made via CTT, GLS, DPD or other. (chosen by Blooming Creative Studio).
Delivery to mainland Portugal takes 1 to 5 working days. For islands, the European Union and other countries, delivery times will be informed to the customer in the quote.
4. Intellectual property
All content and information contained on the website, Etsy store and social networks are the property of Blooming Creative Studio, and therefore, the use, reproduction, copying and dissemination by other means of logos, texts, images and videos contained on these sites is subject to its prior authorization in this regard.

6. Alternative Dispute Resolution

7. Warranty of products and services
Products supplied by Blooming Creative Studio have a 3-year legal warranty.
The warranty is related to manufacturing defects and not misuse, with the product being subject to evaluation to activate the warranty.
Any questions related to the warranty should be sent to the following email address: info@bloomingcreativestudio.pt , stating the defects in the product as well as clear photographs of it.
After activating the warranty, the product may be replaced, repaired, the price reduced or alternatively the contract may be terminated with a refund of the amount thereof (within 14 days after receipt of the product or proof of shipment of the product by the customer, shipping costs to be paid by the company)
The customer may also exercise their right of rejection when terminating the contract or requesting immediate replacement of the product, when the defect appears within 30 days after delivery of the product.

9. Functionality of digital content
For purchases of digital products that use platforms such as Templett, content editing can only be done on a computer. Tablets, smartphones or other devices are not recommended. However, for products that use the Canva platform, they can be edited on computers, tablets and smartphones.
It is not necessary to install any software, but it is recommended to use the Google Chrome browser with its most updated version.
10. Indication of the existence and term of the right of withdrawal
In accordance with the provisions of Law No. 47/2014, of 28/07, the customer has 14 consecutive days to exercise their right to withdraw after contracting Blooming Creative Studio's services. This right of withdrawal does not need to be justified and the amount will be fully refunded, if it has already been paid.
Due to this right of withdrawal period, services will only be performed after the 14 days have elapsed, unless the customer informs otherwise.
After the 14 consecutive days have elapsed, the service will begin and the customer will no longer have the right to exercise their right to withdraw.
This right of withdrawal does not apply to digital products.
12. Other information about the website/sales channel
All content and information on the website and social networks are the property of Blooming Creative Studio, and therefore, the use, reproduction, copying and dissemination by other means of logos, texts, images and videos on these sites is subject to prior authorization.
In the event of any dispute, Blooming Creative Studio seeks prior out-of-court settlement. If this is not possible, the Court to be notified to resolve the dispute must be the Judicial Court of the District of Faro, Silves Central Unit, headquartered at Palácio da Justiça - Cruz de Portugal - 8300-135 Silves.
The above rules apply to all Blooming Creative Studio clients.
Blooming Creative Studio may revise these terms of service for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these terms of service.
