The use of the bloomingcreativestudio.pt website, as well as the acquisition of any products or services from Blooming Creative Studio—whether through the website or the Etsy shop (Bloomingweddingsshop)—implies full acceptance of these Terms and Conditions, drafted in accordance with Decree-Law No. 24/2014, of February 14, with the changes introduced by Decree-Law No. 109-G/2021, of December 10. By making a purchase, you declare that you have read and accepted these Terms and are legally bound by them.

2. Product and Service Characteristics

Blooming Creative Studio sells editable digital stationery templates, primarily for the wedding and events market (invitations, signs, menus, seating charts, among others). Products are provided in digital format, through the following platforms:

•       Templett: online editing platform. The customer receives an access link and needs to create a free account on templett.com to edit the template. Editing is done exclusively on a computer—tablet and smartphone are not recommended.

•       Canva: online design platform. The customer receives a link to the template and can edit it on a computer, tablet, or smartphone after creating a free account on canva.com.

Technical requirements:

•       For Templett templates: the latest version of the Google Chrome browser is recommended. No additional software installation is required.

•       For Canva templates: any updated browser. The Canva app (free) can be used on mobile devices.

No physical printed files are provided. The product delivered is exclusively digital. Colors may show slight variations depending on the monitor or device used, which is inherent to the nature of digital products and does not constitute a defect.

3. Prices and Payment

Prices

•       Product prices are indicated on their respective product page, in the Etsy shop, or on the website.

•       Prices include legally applicable taxes and fees.

•       As these are digital products, there are no shipping or postage costs.

Payment Methods

Payment is made at the time of purchase, through the following means:

•       On the website (main channel): Shopify Payments (debit/credit card) and PayPal;

•       In the Etsy shop: Etsy Payments (debit/credit card, Apple Pay, Google Pay) and PayPal.

No additional customization work will begin without payment confirmation. Placing an order incurs the obligation to pay the indicated price.

4. Delivery of Digital Products

•       After payment confirmation, the customer receives an email with the link to access the template (Templett or Canva), usually immediately or within a maximum of 24 hours.

•       For products that include additional customization by Blooming Creative Studio, the delivery time will be communicated to the customer at the time of purchase or by prior agreement.

•       In case of product unavailability, the customer will be notified and reimbursed within 30 days of the order.

7. Digital Content Guarantee

The digital content provided by Blooming Creative Studio benefits from the legal guarantee stipulated in applicable legislation (3-year period). This guarantee covers defects in the conformity of the digital content relative to its description on the product page.

To activate the guarantee, the customer must contact us at info@bloomingcreativestudio.pt, describing the detected defect. After evaluation, the product may be replaced, corrected, or, if not possible, the customer will have the right to terminate the contract and receive a refund.

The guarantee does not cover difficulties of use resulting from technical incompatibilities of the customer's device, nor the absence of an account on the Templett or Canva platforms.

9. Digital Content Functionality

•       Templett templates are exclusively editable on a computer, using the Google Chrome browser (updated version). They do not require the installation of additional software.

•       Canva templates are editable on a computer, tablet, and smartphone, using the browser or the Canva application.

•       In both cases, creating a free account on the respective platform (Templett or Canva) is required.

•       Any inoperability caused by updates to the Templett or Canva platforms, outside the control of Blooming Creative Studio, is not the responsibility of the latter.

10. Right of Withdrawal and Refund Policy

Pursuant to Article 17, No. 1, subparagraph l) of Decree-Law No. 24/2014, of February 14, the right of withdrawal does not apply to the supply of digital content not provided on a tangible medium, when the performance has begun with the consumer's express agreement and acknowledgement that, by doing so, they lose their right of withdrawal.

By purchasing a digital product from Blooming Creative Studio, the customer expressly consents to the immediate commencement of the contract's performance and acknowledges that, as a result, they lose the right of withdrawal after accessing the digital content.

Exceptions—refunds will be accepted in the following situations:

•       The product has a non-resolvable conformity defect;

•       The customer did not access the template link (provable).

For any refund request, the customer must contact info@bloomingcreativestudio.pt with the subject "REFUND" within 14 days of purchase.

11. Geographic Constraints

•       Blooming Creative Studio's digital products are available to customers worldwide.

•       Blooming Creative Studio operates from Portugal (Monchique).

•       As these are digital products, there are no geographical delivery restrictions or associated customs costs.

12. Other Information

Target Audience

These Terms and Conditions apply to any natural or legal person who accesses the website or purchases products from Blooming Creative Studio, with a consumer being considered anyone acting for purposes not integrated into their professional activity.

Intellectual Property

All content on the Blooming Creative Studio website, Etsy shop, and social media—including designs, texts, logos, images, and templates—is the property of Inês Diogo Varela. The purchase of a template grants the customer a non-exclusive personal use license. Reselling, redistributing, sharing, or commercially using the templates without prior written authorization is strictly prohibited.

Applicable Law and Disputes

These Terms and Conditions are governed by Portuguese law. In the event of a dispute, the parties undertake to attempt an out-of-court resolution. If this is not possible, the Judicial Court of the District of Portimão will have jurisdiction.

Updates

Blooming Creative Studio reserves the right to update these Terms and Conditions at any time for legal or operational reasons. The date of the last update is indicated at the top of the document. Regular consultation of this page is recommended.

Privacy

The processing of personal data collected within the scope of these contractual relationships is governed by Blooming Creative Studio's Privacy Policy, available at bloomingcreativestudio.pt.
